1. GENERAL PROVISIONS

1.1. This Service Agreement (the “Agreement“) is a public offer by AI Gen (the “Provider“) to provide you (the “Customer“) with access to computing resources for AI image and digital content generation on the terms set out below.

1.2. By paying for any paid feature on the website, creating an account, or otherwise using paid services, you accept this Agreement. Payment constitutes acceptance of this offer and forms a binding contract on the terms published on the Site at the time of acceptance.

1.3. The Agreement is effective from the moment of payment (full or partial, as applicable) and remains in force until both parties have fulfilled their obligations.

1.4. Prices and service descriptions are published on the Site: https://ai-gen.online/. The price shown at checkout applies to your order.

1.5. By accepting this Agreement, you confirm that you are at least 18 years old and have the legal capacity to enter into this Agreement.

1.6. The Provider may update this Agreement by publishing a new version on the Site. Changes apply only to orders placed after the updated version is published. Terms for already paid orders do not change without your consent.

1.7. You may contact the Provider regarding the scope or quality of services at support@ai-gen.online within a reasonable time after the service is delivered or while it is being performed.

1.8. Key definitions:

— Service — access to computing resources for AI generation of digital content (including images), and delivery of the generated result as described on the Site for your selected plan.

— Prompt-based generation — generation of digital content from a text or other prompt you submit, under the rates and rules shown on the Site.

— Site — the Provider’s website: https://ai-gen.online/.

— Customer — an individual aged 18 or older who accepts this Agreement by using paid services. You may use the Site as a guest or as a registered user. Account balance and priority queue features are available only to registered users.

— Account — your registered profile on the Site showing order history, account balance, and related information.

— Guest — a user who accesses the Site without registration. Guests may generate watermarked previews for free and may pay for watermark-free downloads on a per-item basis. Account balance and priority queue are not available to guests.

— Account balance — prepaid credits (USD equivalent) added to your Account after payment. Balance may be used only for eligible Site features (priority queue, watermark-free downloads) and is not a stored-value instrument, e-wallet, or payment method. Balance cannot be withdrawn as cash.

— Priority queue — a paid feature that, when sufficient balance is available, prioritizes your generation request ahead of standard queue requests, as described on the Site.

— Watermark-free download — a paid feature to download a generated image at full quality without the Provider’s watermark. Available to guests (one-time payment) and registered users (from balance or direct payment). By default, free previews include a watermark.

2. SUBJECT OF THE AGREEMENT

2.1. The Provider grants access to computing resources for AI generation of digital content under the terms active on the Site when you submit a request. Basic watermarked generation may be offered free of charge without registration. Paid features (watermark-free download, priority queue, balance top-up) are governed by this Agreement.

2.2. Services are informational and technological in nature and are not a sale of physical goods. The deliverable is digital content made available via download link, on-screen access, or other method stated on the Site.

2.3. Service timing depends on the plan shown on the Site. A service is deemed delivered when you receive access to the generation result in the selected format.

2.4. The Provider may change available services by publishing updates on the Site. Changes do not affect orders already paid for.

2.5. You may cancel before delivery begins, subject to Section 4. If delivery has started, you pay only for the portion already provided.

3. PRICING AND PAYMENT

3.1. Watermarked preview generation may be free. Prices for paid features are shown on the Site at the time of purchase.

3.2. The Provider may change prices and terms by publishing updates on the Site. Changes apply to new orders only.

3.3. Guests pay for watermark-free downloads via one-time checkout. Registered users may pay from Account balance or combine balance with direct payment. Balance top-up is available in the Account area.

3.4. Payment is complete when funds are confirmed by the payment processor shown on the Site. You are responsible for accurate payment details.

3.5. Unless otherwise stated on the Site, prices are shown in US dollars (USD).

3.6. For payment receipts or billing questions, contact support@ai-gen.online.

3.7. Balance top-up is prepaid access to computing resources. Credited amounts are not deposits and cannot be transferred to other users.

3.8. Balance may be used only for priority queue and watermark-free downloads on the Site.

3.9. Balance cannot be redeemed for cash.

3.10. Balance expiration. Unless stated otherwise on the Site, unused balance expires on December 31 of the calendar year in which it was credited (11:59 PM US Eastern Time) and does not roll over. Expiration is not grounds for a cash refund because top-up is prepaid access for that period. You accept this when adding balance.

4. REFUNDS

4.1. Refunds are handled as required by applicable U.S. law and this Agreement when you submit a written request.

4.2. Send refund requests to support@ai-gen.online. Include: description of the paid service, payment date and method, reason for the request, and contact email. Refunds, when approved, are generally returned to the original payment method.

4.3. Refund amount equals the price paid minus the value of services already delivered and documented Provider costs. Delivered results (download access or completed generation) are non-refundable for that portion. Balance top-ups are non-refundable except where required by law or expressly stated on the Site.

4.4. Approved refunds are processed within 10 business days after we receive a complete request. Bank or card processing times are additional.

4.5. Cash refunds are not available.

5. RIGHTS AND OBLIGATIONS

5.1. The Provider will:

— provide services as described on the Site;

— deliver generation results by the method selected on the Site;

— review reasonable customer inquiries in a timely manner.

5.2. The Provider may:

— use third-party payment and cloud providers while remaining responsible to you;

— withhold paid delivery until payment is confirmed;

— suspend or terminate access for material breach, with refund of unused prepaid amounts where applicable under Section 4.

5.3. You will:

— pay for selected services;

— provide accurate contact and order information;

— use generated content lawfully and not infringe third-party rights;

— submit prompts that comply with applicable law and do not request illegal, harmful, or infringing content;

— use balance only as permitted in Section 3 and before expiration under Section 3.10.

5.4. You may:

— request services as described on the Site;

— contact support at the addresses listed on the Site;

— cancel before delivery under Section 4.

6. LIABILITY

6.1. Each party is liable for failure to perform as required by applicable law and this Agreement.

6.2. The Provider is not liable for outages of the Site, payment systems, or third-party infrastructure, temporary unavailability of generation resources, or the substance of output produced from your prompt. You are solely responsible for your prompts and lawful use of results.

6.3. You will indemnify the Provider against claims arising from your prompts, your use of generated content, or your breach of this Agreement, to the extent permitted by law.

6.4. Neither party is liable for failure caused by force majeure after reasonable notice to the other party.

7. DISPUTE RESOLUTION

7.1. Parties will attempt to resolve disputes through good-faith negotiation.

7.2. Before litigation, you must send a written notice to support@ai-gen.online. We will respond within 30 calendar days. This Agreement is governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law rules, except where mandatory consumer protection laws of your state of residence apply. Exclusive jurisdiction for disputes not resolved informally lies in state or federal courts located in Delaware, unless applicable law requires otherwise.

7.3. If any provision is held invalid, the remaining provisions remain in effect.

8. PRIVACY

8.1. Information collected to perform this Agreement is handled under our Privacy Policy: https://ai-gen.online/policy/.

8.2. By using paid services, you acknowledge that processing described in the Privacy Policy may occur. Where consent is required by law, you provide it as described on the Site and in the Privacy Policy.

8.3. Each party will protect confidential information received under this Agreement except where disclosure is required by law.

9. INTELLECTUAL PROPERTY

9.1. The Site, its design, text, logos, and other materials belong to the Provider or its licensors. You may not copy Site materials without permission.

9.2. When you pay for watermark-free download, you receive rights to use the corresponding generated image as stated on the Site for personal and commercial purposes, subject to applicable law and third-party rights. Free watermarked previews are for evaluation; full usage rights attach upon paid download unless otherwise stated on the Site.

10.2. This offer is published on the Site and forms part of your contract from the moment of acceptance by payment or use of paid services.
